Among the material losses that constitute a large part of the losses inflicted on individuals and can be compensated according to this theory, is lack of profit. The fact is that the jurisprudence of international courts and arbitration authorities is very much influenced by these international commercial laws; In such a way that the lack of benefit is certain and even in some cases the possible lack of benefit can be demanded. However, there is no compensation for such damages in the local domestic legal procedure of the Arabs, and only in few cases, with the fulfillment of several conditions, compensation is ordered. امروزه بحث از مسئولیت اشخاص در برابر یکدیگر در پی نقض تعهدات قراردادی و بروز خسارات مادی و معنوی به شدت پررنگ می باشد و این امر موجب شکل گیری نظریه جبران خسارت کامل در برابر زیان دیده گردیده است؛ نظریه ای که در قوانین متعدد تجاری بین المللی مانند کنوانسیون بیع بین المللی کالا و اصول قراردادهای تجاری بین المللی به رسمیت شناخته شده است و هدف آن جبران کامل خسارات و حمایت از زیان دیده می باشد. از جمله ضررهای مادی که بخش وسیعی از ضررهای وارده به اشخاص را تشکیل می دهد و به موجب این نظریه قابلیت جبران دارد، عدم النفع است. واقعیت آن است که رویه قضایی محاکم و مراجع داوری بین المللی بسیار متأثر از این قوانین تجاری بین المللی می باشد؛ به نحوی که عدم النفع مسلم و حتی در برخی از موارد عدم النفع احتمالی را قابل مطالبه می داند. اما جبران چنین خسارتی در رویه قضایی داخلی محلی از اعراب ندارد و تنها در موارد اندکی آن هم با احراز شرایطی چند، حکم به جبران آن داده می شود. http://www.jgeoqeshm.ir/article_177823_86e198345ff9cdabded921b319ee8cb0.pdf
