بررسی تطبیقی مبانی جبران خسارت ناشی از نقض قرارداد در نظام های حقوقی کشورهای ایران، کانادا و فرانسه با تاکید بر رهیافت ها و دستاوردها

چکیده

نقض تعهدات قراردادی به عنوان یک رفتار خلاف اصل وفای به عهد اصولا در هر نظام حقوقی واجد مسئولیت های مختلف مدنی، اداری و حتی کیفری می باشد و در این زمینه، جبران خسارت ، مهم ترین واکنش قانونی است که قانون گذاران پیش بینی نموده اند. اگرچه در برخی نظام های حقوقی مانند کانادا و فرانسه، اصول اخلاقی از جمله اصل منع سوءاستفاده از حق جبران خسارت نیز پیش بینی شده اند. سوال اصلی تحقیق حاضر آن است که مبانی جبران خسارت ناشی از نقض قرارداد در هر یک از نظام های حقوقی ایران ، کانادا و فرانسه چه تفاوت هایی با یکدیگر دارند ؟ نتیجه تحقیق حاضر آن است که با توجه به اینکه مبانی اصلی جبران خسارت در حقوق ایران ، قواعد فقهی هم چون قاعده لاضرر، قاعده احترام ، قاعده سد ذرایع است که جبران خسارت های مستقیم و مشروع را مورد توجه قرار می دهند. در این راستا، جبران خسارت های احتمالی و خسارت های تنبیهی که به ویژه در حقوق کانادا مورد توجه قرار می گیرند، در نظام حقوقی ایران قابل حصول نیست. در مقابل، در نظام حقوق فرانسه، مبانی نظری جبران خسارت ناشی از نقض قرارداد بر مبنای منفعت عمومی توجیه شده و عمدتا بر مبنای اصل حفظ منفعت عمومی، اصل احترام به حقوق مکتسبه و اصل لزوم ارایه اطلاعات توجیه می شوند. نهایتا، در نظام حقوق کانادا، بر مبنای اصل حسن نیت و اصل انصاف به عنوان دو اصل برجسته کامن لایی، جبران خسارت ناشی از نقض قرارداد پیش بینی می گردد.

Compensation is also provided. The main question of the present study is that what are the differences between the principles of compensation for breach of contract in each of the legal systems of Iran, Canada and France? The result of the present study is that considering that the main principles of compensation in Iranian law are jurisprudential rules such as the rule of no harm, the rule of respect, the rule of dams, which consider the compensation of direct and legitimate damages. In this regard, compensation for possible damages and punitive damages, which are especially considered in Canadian law, can not be achieved in the Iranian legal system. In contrast, in the French legal system, the theoretical foundations of compensation for breach of contract are justified on the basis of the public interest, and are mainly justified on the basis of the principle of protection of the public interest, the principle of respect for acquired rights and the principle of the need to provide information. Finally, in the Canadian legal system, based on the principle of good faith and the principle of fairness as two prominent principles of common law, compensation for breach of contract is provided.
