A comparative study of the principles of compensation for breach of contract in the legal systems of Iran, Canada and France with emphasis on approaches and achievements

Abstract

Compensation is also provided. The main question of the present study is that what are the differences between the principles of compensation for breach of contract in each of the legal systems of Iran, Canada and France? The result of the present study is that considering that the main principles of compensation in Iranian law are jurisprudential rules such as the rule of no harm, the rule of respect, the rule of dams, which consider the compensation of direct and legitimate damages. In this regard, compensation for possible damages and punitive damages, which are especially considered in Canadian law, can not be achieved in the Iranian legal system. In contrast, in the French legal system, the theoretical foundations of compensation for breach of contract are justified on the basis of the public interest, and are mainly justified on the basis of the principle of protection of the public interest, the principle of respect for acquired rights and the principle of the need to provide information. Finally, in the Canadian legal system, based on the principle of good faith and the principle of fairness as two prominent principles of common law, compensation for breach of contract is provided.
