استقلال نهاد تنظیم‌گر و ارتقای رقابت در حمل‌ونقل ریلی ایران: تحلیلی بر مبنای حقوق رقابت و تجارب تطبیقی کشورهای منتخب

چکیده
در چشم‌اندازی نهادگرایانه و حقوقی، تنظیم‌گری مستقل به‌مثابه سنگ‌بنای تحقق حاکمیت مطلوب در بازارهای زیرساختی، خصوصاً صنعت حمل‌ونقل ریلی، جایگاهی راهبردی ایفا می‌کند. امروزه با توجه به پیچیدگی اقتصاد مدرن و گسترش انحصارهای طبیعی در بخش‌هایی مانند حمل‌ونقل ریلی، صرف تکیه بر رقابت آزاد پاسخگوی چالش‌های پنهان ناشی از قدرت غالب بازار، ناکارآمدی ساختارها و تضاد منافع نیست و نقش نهاد تنظیم‌گرِ با استقلال ساختاری و عملیاتی، در پرتو اصول حقوق رقابت و رویکردهای تطبیقی کشورهای پیشگام، بیش از هر زمان دیگر، برجسته می‌گردد.بررسی حاضر ضمن پیوند نظریه‌های حقوق عمومی و اصول نهادگرایی با مقتضیات حقوق رقابت، ساختار تنظیم‌گری صنعت حمل‌ونقل ریلی ایران را واکاوی می‌کند و نشان می‌دهد که تمرکز قدرت، تداخل وظایف، فقدان شفافیت و ضعف سازوکارهای پاسخگویی، موانع اصلی ارتقای رقابت و کنترل انحصار هستند. این پژوهش با روش توصیفی ـ تحلیلی و تکیه بر مطالعات تطبیقی، مدل‌های نهادی کشورهای منتخب OECD را واکاوی نموده و تأکید می‌کند که استقلال مالی، نهادی و تصمیم‌گیری تنظیم‌گر، به همراه شفاف‌سازی روابط با دولت و بخش خصوصی، ابزار اساسی کاهش ریسک سوءاستفاده‌های انحصاری و تسریع جذب سرمایه و توسعه‌بخشی بازار است.یافته های این پژوهش نشان می‌دهد که تأسیس نهاد تنظیم‌گر مستقل، با جدایی روشن سه وظیفه سیاست‌گذاری، بهره‌برداری و تنظیم‌گری و بهره‌مندی از سازوکارهای نظارتی فراگیر و شفاف، موجب تقویت اعتماد عمومی، ارتقای رقابت‌پذیری بازار و کاهش معضلات ساختاری خواهد شد.در نهایت، نتایج حاصل حاکی از آن است که گذار موفق به مدل حکمرانی رقابتی، جز با اصلاح اساسی قوانین، بازطراحی ساختار نهادهای تنظیم‌گر بر اساس الگوهای جهانی و تضمین

From an institutional and legal perspective, independent regulation plays a strategic role as a cornerstone for achieving desirable governance in infrastructure markets, especially the rail transport industry. Today, given the complexity of the modern economy and the spread of natural monopolies in sectors such as rail transport, relying solely on free competition is not a solution to the hidden challenges arising from dominant market power, structural inefficiency, and conflict of interest. The role of a regulatory institution with structural and operational independence, in light of the principles of competition law and comparative approaches of leading countries, is more prominent than ever. The present study, while linking public law theories and institutional principles with the requirements of competition law, examines the regulatory structure of the Iranian rail transport industry and shows that concentration of power, overlapping duties, lack of transparency, and weak accountability mechanisms are the main obstacles to promoting competition and controlling monopoly. This research, using a descriptive-analytical method and relying on comparative studies, examines the institutional models of selected OECD countries and emphasizes that financial, institutional, and regulatory decision-making independence, along with transparency in relations with the government and the private sector, are essential tools for reducing the risk of monopoly abuses and accelerating capital attraction and market development. The findings of this research show that the establishment of an independent regulatory institution, with a clear separation of the three tasks of policymaking, exploitation, and regulation, and the use of comprehensive and transparent supervisory mechanisms, will strengthen public trust,
